Fire Department Notification Registration

The Governor signed Assembly Bill No. 898 on August 22, 2016. The bill expands Penal Code section 3042, subdivision (a) by requiring the Board of Parole Hearings (Board) or the Department of Corrections and Rehabilitation, in the case of a person who was convicted of the murder of a firefighter, to provide notice of the parole suitability hearing to the fire department that employed the firefighter, if the fire department registers with the Board to receive that notification and provides the appropriate contact information.

Fire Department Registration

If you would like to register your fire department to receive notice of future parole consideration hearings, please provide the following information in your request:

  • Fire department’s name, address, and phone number
  • Department’s contact person and contact information
  • Victim’s name
  • Offender’s name, CDCR number, and date of birth (if known)

Notification

Pursuant to Penal Code Section 3042(a), at least 30 days before the Board meets to review or consider the parole suitability of any person sentenced to a life sentence, the Board shall send written notice thereof to the registered fire department that employed the firefighter at the time of the murder.

Departmental Comments/Recommendations

Your written comments and recommendations are respectfully invited for submission to the Board. Please submit your written response attached to the hearing notice no later than 10 days prior to the Monday of the hearing week. If you have documents or reports which include information about the incarcerated person, the person’s offense(s), or the person’s prior criminal history, you are encouraged to submit those along with your comments and recommendations.

Availability of Hearing Transcript

Within approximately 30 days upon completion of the incarcerated person’s parole suitability hearing before the Board, a stenographic record (transcript) of the hearing is available upon request.
